தனியார் வீடு என்று அனுமதி பெற்று ஹெபரான் சர்ச் கட்டியது: ஹெபரான் சர்ச் என்று இரு கிருத்துவ சர்ச்சை கே. பி. எடிசன் என்பவர் நடத்தி வருகிறார் [Dr. K.B. Edison,. Hebron Castle Church,. Phone: 044-28170007]. முதலில் சிறியதாக ஆரம்பித்தது, நாளடைவில் பெரிய கட்டடமாக மாறியது. அதுமட்டுமல்லாது, தனியார் வீடு என்று தான் சி.எம்.டி.ஏ.,விடம் திட்ட அனுமதி பெற்றார். ஆனால் பணம் வரவர, அடுக்கு மடி கட்ட ஆரம்பித்தார். பிறகு, வெளீப்படையாக சர்ச், ஊழியம், என்று கூட்டம் கூடியதால், அக்கம்-பக்கம் உள்ளவர்களுக்கு தொந்தரவு ஏற்பட்டது. மூன்று மாடி கட்டடம் என்று ஆரம்பித்து, ஏழு மாடிகள் கட்ட ஆரம்பித்தார். மேலும், கல்யாண மண்டபம் எனவும் வாடகைக்கு விட ஆரம்பிக்கப் பட்டது. இதனால், வருபவர்களின் எண்ணிக்கை பெருக, கார்கள், வேன்கள் என்று வந்த வாகனங்கள் சுற்றியுள்ள தெருக்களை ஆக்கிரமித்துக் கொண்டன. இதனால், அப்பகுதி மக்களுக்கு பெருத்த தொந்தரவு ஏற்பட்டது. இதனால், லேக் ஏரியா குடியிருப்பு சங்கம் என்ற அமைப்பு, சென்னை உயர்நீதி மன்றத்தில் வழக்குத் தொடர்ந்தது. வீடு என்று அனுமதி வாங்கிக் கொண்டு, பிறகு, சர்ச், கல்யாண மண்டபம் என்று மதம் மற்றும் வணிக ரீதியில் உபயோகப்படுத்தப்படுவதால், அங்கு உடியிருக்கும் அக்களுக்கு பலவிதமான தொந்தரவுகள் ஏற்படுகின்றன, அதனால், விதிமீறல் முறையில் தகுந்த நடவடிக்கை எடுக்கப்பட வேண்டும் என்று செப்டம்பர் 2016ல் முறையிட்டனர்[1]. முன்னர் அனுமதி மறுக்கப்பட்டதற்கு எடிசனும் முறையிட்டார்[2].
வீடு சர்ச் ஆகி, கல்யாண மண்டபம் ஆனது: நுங்கம்பாக்கம் லேக் ஏரியா பகுதியில், விதிமீறல் உள்ளதாக புகார் கூறப்பட்ட தேவாலய கட்டடத்துக்கு, ‘சீல்’ வைக்க, சென்னை மாநகராட்சிக்கு, தமிழக அரசு உத்தரவிட்டு உள்ளது. சென்னை நுங்கம்பாக்கம், வள்ளுவர் கோட்டம் அருகில், லேக் ஏரியா, 7வது தெருவில், தனியார் ஒருவர், தேவாலயம் மற்றும் மண்டப பயன்பாட்டுக்காக அடுக்குமாடி கட்டடத்தை கட்டி உள்ளார். இதற்காக, அவர், 2006ல் சென்னை பெருநகர் வளர்ச்சி குழுமமான சி.எம்.டி.ஏ.,விடம் திட்ட அனுமதி பெற்றார். ஆனால், இந்த அனுமதியில் குறிப்பிடப்பட்ட விதிமுறைகள் மீறப்பட்டதாக புகார் கூறப்பட்டது. இது தொடர்பாக, லேக் ஏரியா குடியிருப்போர் சங்கம் சார்பில், வீட்டு வசதி மற்றும் நகர்ப்புற வளர்ச்சி துறைக்கு, 2016 ஜூனில், மனு அளிக்கப்பட்டது. அதில், லேக் ஏரியாவில் கட்டப்பட்டு உள்ள அடுக்குமாடி கட்டடத்தில் விதிமீறல்கள் இருப்பதாகவும், இதனால் அங்கு ஏற்படும் பிரச்னைகள் குறித்தும் விரிவாக விவரிக்கப்பட்டு இருந்தது. மேலும், ‘கட்டட உரிமையாளர், வரன்முறை தொடர்பாக அரசிடம் மேல் முறையீடு செய்து உள்ளார். அந்த கட்டடத்தை வரன்முறைபடுத்துவதை கடுமையாக எதிர்க்கிறோம்’ எனவும் மனுவில் குறிப்பிடப்பட்டு உள்ளது.
சி.எம்.டி.ஏ மற்றும் சென்னை உயர்நீதி மன்றம் நிராகரித்து தீர்ப்பு வழங்கியது: இது குறித்து வீட்டு வசதி மற்றும் நகர்ப்புற வளர்ச்சி துறை உயர் அதிகாரி ஒருவர் கூறியதாவது[3]: “கட்டட உரிமையாளர் தரப்பு விளக்கத்தை கேட்க, உரிய கால அவகாசம் வழங்க வேண்டும் என்ற உயர் நீதிமன்ற உத்தரவுப்படி, அவருக்கு நேரம் ஒதுக்கப்பட்டது. அதன் பின் அந்த குறிப்பிட்ட கட்டடத்தில் விதிமீறல்கள் இருப்பது உறுதி செய்யப்பட்டு, ‘சீல்‘ வைப்பதற்கான நோட்டீஸ் ஏற்கனவே வழங்கப்பட்டது. ஆனால், உரிமையாளர் நீதிமன்ற தடை பெற்று நடவடிக்கையை முடக்கினார். இந்நிலையில், கட்டட உரிமையாளர், குடியிருப்போர் சங்கம் ஆகிய தரப்பு கருத்துகளை கேட்ட பின், கட்டடத்துக்கு சீல் வைப்பதற்கான நடவடிக்கை எடுக்க, சி.எம்.டி.ஏ., மற்றும் மாநகராட்சி அதிகாரிகளுக்கு உத்தரவிடப்பட்டது”, இவ்வாறு அவர் கூறினார்[4]. பிப்ரவரி 2017லேயே, சென்னை உயர்நீதி மன்றம் இந்த ஆணையை, “மூன்று மாடிகளுக்கு பதிலாக, ஆறு மாடிகள் மனுதாரர் கட்டியுள்ளார். அதனால், அவரது சீரமைப்பு மனு சி.எம்.டி.ஏ.வால் ஏற்கனவே தள்ளுபடி செய்யப்பட்டது. இந்நிலையில், இரண்டு மாத காலம் அவகாசம் அளிக்கப்படுகிறது. அதற்குள் அவர் விதிமீறலை சரிசெய்து கொள்ள வேண்டும், இல்லையென்றால், சி.எம்.டி.ஏ சட்டப்படி உரிய நடவடிக்கை எடுக்கலாம்” என்று, வெளியிட்டது[5].
நடவடிக்கை எடுக்க வந்த போது பெண்களை வைத்து போராட்டம் நடத்தியது: சென்னை உயர்நீதி மன்றம் மற்றும் சி.எம்.டி.ஏ ஆணைகளையும் மீறி, சீல் வைக்க வந்த அதிகாரிகளின் மீது, பெண்களை வைத்து தாக்குதல் நடத்தும் விதத்தில் எதிர்ப்புத் தெரிவிக்கப் பட்டது. 10-07-2017 அன்று சென்றபோது, வாக்குவாதம் நடந்தது, அதிகாரிகளையும் அவர்கள் மிரட்டினர். இதனால், 12-07-2017 அன்று போலீஸ் பாதுகாப்புடன் மாநகராட்சி அதிகாரிகள் அங்கு சென்றனர். அதனால், அங்கிருந்த கும்பல், சீல் மற்றும் நோட்டீஸை கிழித்து எரிந்தனர், எரிக்கவும் செய்தனர். மாநகராட்சி அதிகாரிகளைத் தாக்கவும் செய்தனர். இதனால், அவர்களுக்கு காயம் ஏற்பட்டது. மறுபடியும் அவர்கள் போலீஸாரிடம் சென்று முறையிட்டனர். அதனால், போலீஸார் அங்கு வந்தனர். அக்கூட்டமும் கலைந்து சென்றது. பிறகு, மாநகர அதிகாரிகள் தங்களது ஊழியர்களுடன், விதிமுறைகளுக்கு மீறி கட்டிய பகுதியை இடிக்க ஆரம்பித்தனர். ஆக, சிறிய விசயம் பெரிதாக்க்கப் பட்டது போல காணப்படுகிறது. ஆனால், எடிசன் இங்கு மைனாரிடி கார்டை உபயோகப் படுத்தியிருப்பது தெரிகிறது.
நம்பிக்கையாளர்களுக்கு சமவுரிமை உள்ளதா இல்லையா என்ற கேள்வி எழுகின்றது: எடிசன் ஆரம்பத்திலிருந்தே, தாங்கள் கிருத்துவர்கள், மைனாரிட்டி, அதனால், தங்கள் மீது ஒன்றும் செய்ய முடியாது என்ற ரீதியில் செயல்பட்டு வந்தார். அதனால் தான், வீடு சர்ச்சாகி, ஜெபகூடம், கல்யாண மண்டபம் ஆகியது. கூட அயல்நாட்டு நிதியுதவியு,ம் கிடைக்க, புத்தகங்கள், சிடி வெளியீடு, ஜெப கூட்டங்கள், வீடியோ நிகழ்ச்சிகள் என்று அதிகமாகின. இணைதளங்களில் அதிரடியாக தன்னைப் பற்றி விளம்பரம் செய்து கொள்ள ஆரம்பித்தார்[6]. சர்ச் உண்டாக்குதல் [Church planting], அறுவடை செய்தல் [harvest], 2017ல் பாவம் செய்த விக்கிர ஆராதனையாளர்களுக்கு ஒளி காட்டுதல் [“The Gentiles shall come to your light, And kings to the brightness of your rising] என்றெல்லாம், வெளிப்படையாக இருக்கின்றன. ஆக, மறுபடியும், செக்யூலரிஸ நாட்டில், இவ்வாறெல்லாம், கிருத்துவர்கள் செய்ய முடியுமா என்ற கேள்விதான் எழுகின்றது. உரிமைகள் என்றால், எல்லோருக்கும் உரிமைகள் இருக்கின்றன. அப்பொழுது எடிசன் போன்றோர், இவ்வாறு வரம்பு மீறி செய்ய முடியாது. நம்பிக்கையாளர்களுக்கு சமவுரிமை உள்ளதா இல்லையா என்ற கேள்வியும் எழுகின்றது. ஏனெனில், செக்யூலரிஸ நாட்டில் அத்தகைய உரிமைகள் சமமாகத்தான், இருக்க வேண்டும். ஆனால், சமமாக இல்லாமல், நீதியின் தராசின் தட்டு, ஒன்று மட்டும் உயர்ந்தால், அடுத்த தட்டு தாழ்கிறது, சமநிலை பாதிக்கின்றது என்றாகிறது.

[1] It is the case of the petitioner that the fourth respondent had obtained permission to put up a residential house but, however, is using the building for commercial activities by running a Church cum Kalyana Mandapam. Hebron church to bring down 3 illegal floors in 8 weeks

Chennai: The six-storey Hebron Castle Church in Nungambakkam, which was issued a lock-and-seal order by the Madras high court, has got an eight-week stay from the Supreme Court.
The stay order came on Thursday with a condition that the unauthorised top three floors of the church be demolished in that eight-week period.
Following attempts of Greater Chennai Corporation to lock the church, pastor KB Edison, petitioned in the Supreme Court to get a stay on the HC order.
“There are several other establishments in the vicinity, but only this church seems to be a problem for the people who petitioned for its closure,” said a church-goer, who did not want to be named.
“After getting the stay order, we have approached the state Housing Board department to submit necessary documents. We are looking forward to getting approval for the remaining three floors of the church,” said CJ Zeba, secretary of the Tamil Nadu Christian Council. He added that they are expecting to get an approval in the eight-week period of the stay.

2. Heard the learned counsel for the parties.

It is the case of the petitioner that after obtaining planning permission from CMDA for construction of basement + stilt + ground + three floors in the year 2006, the entire construction was structurally over by early 2007. According to the petitioner, there are marginal variations in the construction from the approved plan. Complaints were lodged by the neighbours and proceedings were initiated by the department to lock and seal the premises. The petitioner alleges that he had filed two separate appeals under Section 79 and 80A of the Tamil Nadu Town and Country Planning Act, 1971. The review petition filed by the petitioner was rejected by the impugned order dated 31.1.2017. Assailing the same, the present writ petition is filed.
4. At the outset, the learned counsel for the petitioner seeks a direction that a policy decision should be taken by the Government to regularize the unauthorized constructions. It is contended that the appeal of the petitioner filed under Section 79 of the Tamil Nadu Town and Country Planning Act has not been considered by the respondent/authorities till date and without passing any order in this appeal the review petition is rejected and, therefore, the same should be set aside.

The learned Special Government Pleader appearing for the first respondent submits that there is no scope for entertaining a review petition and in fact, there is no provision for reviewing the orders passed. It is also contended that there is no appeal filed under Section 79 of the said Act pending on the file of the first respondent.
6. It is trite that matters relating to framing and implementation of policy primarily fall in the domain of the Government. It is for the Government to frame any policy as it may deem fit and proper and there cannot be a mandamus issued in this regard.
7. Coming to the case on hand, it transpires that instead of three floors, the petitioner has put up six floors, for which he has sought for regularization and the same was rejected. Therefore, we do not find any reason to interfere with the impugned order rejecting the review petition filed by the petitioner. However, considering the facts and circumstances of the present case, we grant two months time to the petitioner to bring the construction in conformity with the approved plan. If the petitioner fails to comply with the said direction within the stipulated time, the respondent/authorities are at liberty to proceed in accordance with law.
The writ petition is disposed of accordingly. No costs. Consequently, W.M.P.Nos.4482 and 4483 are closed.

(Order of the Court was made by HULUVADI G. RAMESH,J.) With the consent of all the parties, the writ petition is taken up for final disposal at the stage of admission itself.

This Writ Petition is filed praying to issue a Writ of Mandamus to direct the respondents 2 and 3 to forthwith implement the orders of the 1st respondent in letter No. 12403/UD-VI(1)/2016-3 dated 19.08.2016 by ensuring that the subject building is discontinued from being put to use by the 4th respondent.
3. Pursuant to the order issued by this Court in the W.P. No.6975 of 2013, the fourth respondent approached the first respondent by filing a revision petition and also obtained an order of interim relief protecting the property, till the disposal of the revision petition filed by him before the first respondent. On 22.08.2016, the first respondent has dismissed the appeal of the fourth respondent. Hence, the petitioner, members of the Association, are before this Court, to execute the order.

It is submitted that the second respondent CMDA had already dismissed the regularisation application of the fourth respondent and the appeal under Section 80A has also been rejected by the Government, viz., the first respondent. In the above backdrop, it is the bounden duty of the second respondent, Chennai Metropolitan Development Authority to do the needful in accordance with law, by issuing show cause notice to the fourth respondent and after affording an opportunity of personal hearing to the petitioner as well as to the fourth respondent, the persons who are likely to be affected, and, after hearing pass orders thereon, in accordance with law within a period of three months from the date of receipt of a copy of this order.
7. The Writ Petition is disposed of with the above direction. No costs. Consequently, the connected Miscellaneous Petition is closed.
