மே மாதம் 2006ல் வாடிகணிலிருந்து வந்த பதில் கடிதத்தில், “………..அந்த ஆளுடைய நடவடிக்கை கண்காணிக்கப் படவேண்டும். இதற்கு மேலும் அவன் சிறுமியர்களுக்கு எந்த அபாயத்தையும் ஏற்படுத்தாதவாறும், நம்பிக்கையுள்ளவர்களிடையே அவதூறு ஏற்படும் வகையில் எதையும் செய்யாமல் பார்த்துக் கொள்ளவேண்டும்”, என்றும் பரிந்துரைத்தது. ஆனால் அதற்குள் அவன் மேல் மேலும் குற்றச்சாட்டுகள் எழுந்தன. அப்பொழுது அவன் எங்கே என்று தேடியபோதுதான், ஊட்டியில் ஜாலியாக இருந்தது தெரிய வந்துள்ளது. இணைதளத்தில் எல்லா கடிதங்களும் வெளியிடப் பட்டுள்ளன. அவை எல்லாமே பிஷப் / பாதிரி ஏ. மலையப்பன் சின்னப்பா, ஏ. அந்தோனிசாமி, அருளப்பன் அமல்ராஜ்…………………………என்ற எல்லொருக்க்ம் 2005லிருந்தே நன்றாகத் தெரியும். இருப்பினும்., அந்த காமுகனின் செயலை மறைத்த் விதம் ஆச்சரியமாகவே உள்ளது.

    A Catholic priest who has been criminally charged with sexually assaulting a 14-year-old girl in Minnesota six years ago is still working in his home diocese in India despite warnings to the Vatican from an American bishop that the priest continued to pose a risk to children, according to church documents made public on Monday.

    The documents show that the American bishop warned the Vatican that the priest was accused of molesting two teenage girls whose trust he gained by promising to discuss their interest in becoming nuns.

    A county attorney in Minnesota is seeking to extradite the priest from India in a criminal case that involves one of the girls, who said the priest had forced her to perform oral sex and had threatened her and her family.

    The case took place during the papacy of Pope Benedict XVI, who has recently come under fire for his role in cases of sexually abusive priests in Germany and Wisconsin.

    The case was handled after the Vatican clarified and streamlined its procedures in 2001 to respond to accusations of sexual abuse by priests. In the midst of a growing scandal, the Vatican has sought to defend the pope by pointing out that he was both an architect and a promoter of these procedures.

    But the Vatican also says it defers to local bishops to decide how to treat accused priests, leaving it exposed to criticism that the church is not doing enough to rein in sexually abusive priests.

    In 2006, the Vatican recommended that the priest simply be monitored, a document shows. A lawyer for the Holy See said in a statement that the Vatican had recommended that the priest be defrocked, but that canon law specifies that the decision rests with the local bishop. The bishop in India sentenced the priest to a year of prayer in a monastery rather than seeking his removal from the priesthood, according to documents and interviews.

    The priest, the Rev. Joseph Palanivel Jeyapaul, was working temporarily in the Diocese of Crookston, Minn., which like many United States dioceses is bringing in priests from India because there are not enough American priests to serve its parishes. Father Jeyapaul ministered to three parishes simultaneously in Crookston, where he was accused of misappropriating church funds as well as sexual abuse.

    A lawyer for the Holy See, Jeffrey Lena, said in a statement on Monday that the Vatican had cooperated with law enforcement authorities seeking the priest’s extradition and had provided the location of the priest in India.

    Lisa B. Hanson, the county attorney in Roseau, Minn., said, “Maybe all this attention has gotten them to change their tune, and if that’s the case we’ll take their cooperation.”

    Mr. Lena also said that the Vatican office in charge of handling abuse cases, the Congregation for the Doctrine of the Faith, had recommended laicization, which is removal from the priesthood.

    Mr. Lena said in the statement: “The Congregation for the Doctrine of the Faith suggested in this matter that Father Jeyapaul agree to laicization, demonstrating that the Congregation believed that the accusations were serious enough to merit dismissal from the clerical state. However, as a matter of longstanding canon law, such decisions are made by the local bishop, who is deemed to be generally in the best position to adjudicate the case relating to the priest in question.” He declined to provide any documents on the case.

    The bishop of Ootacamund, India, Arulappan Amalraj, told The Associated Press, which first reported the news on Monday, that Father Jeyapaul had no contact with children and would remain in the diocesan offices.

    “We cannot simply throw out the priest, so he is just staying in the bishop’s house, and he is helping me with the appointment of teachers,” the bishop said. “He says he is innocent, and these are only allegations. I don’t know what else to do.”

    Father Jeyapaul told The A.P., “It is a false accusation against me. I do not know the girl at all.”

    The criminal complaint from Minnesota said that the 14-year-old girl, whose name is redacted, was praying after school at Blessed Sacrament Church in Greenbush, Minn., when Father Jeyapaul told her to come into the rectory. The girl claimed that when she refused to touch his genitals, he told her it was a sin and said he “could make her life miserable.” She said he then pushed her down onto a couch, touched her breasts and pulled down his pants.

    The woman, now 20, has brought a lawsuit against the Diocese of Crookston. The documents were released in a news conference on Monday by her lawyers, Jeff Anderson and Mike Finnegan, the same lawyers who gave documents last month to The New York Times on another case involving a Wisconsin priest who molested as many as 200 deaf boys.

    The former bishop of Crookston, Victor H. Balke, wrote to Cardinal William J. Levada, the head of the Congregation for the Doctrine of the Faith, in 2005, requesting that the Congregation handle the case itself.

    “I cannot in good conscience allow this matter to be passed over because the cleric has left my territory,” Bishop Balke wrote. “In my mind that would be a shameful act of betrayal towards the women and girls in India to whom Fr. Jeyapaul could at present pose a serious risk.”

    He received a letter back in May 2006 from Archbishop Angelo Amato, in the Vatican, saying that the Congregation conveyed the facts to the bishop in India “with the request that Father Jayapaul’s priestly life be monitored so that he does not constitute a risk to minors and does not create scandal among the faithful.”

    Bishop Balke subsequently sent two more letters to Cardinal Levada informing him that a second alleged victim had come forward with more serious allegations, that criminal charges had been filed and that the county attorney wanted to extradite Father Jeyapaul. He pleaded for quick action. Bishop Balke also wrote to the Vatican’s top diplomat to the United States, Archbishop Pietro Sambi, who provided the address of Father Jeyapaul in India, to give to the county attorney.

    Church offices were closed on Easter Monday, and officials in the Diocese of Crookston did not respond to messages left by phone and e-mail.

    Your Excellency, I am writing to you as the Metropolitan of the Diocese of Ooctacamund, to request your assistance in a matter involving a priest of that diocese, Fr. Joseph Jeyapaul. For the past several weeks I have been trying to communicate with the Diocesan Administrator of Ooctacamund, but as yet have not received any response. Given the seriousness of the issues which I wish to discuss with him, I request your assistance in facilitating the necessary conversations. Until recently, Fr. JeyapauI was serving as an extern priest in my diocese of Crookston, Minnesota. During his time here he developed an unusual friendship with a young girl from a neighboring town, and that friendship has led to allegations that he committed acts of sexual misconduct towards her. According to both canon law and civil law the girl is a minor, and the alleged misconduct can be categorized as sexual abuse. Thus as is required by both the particular law of the United States and the universal law of the Roman Catholic Church, I have initiated a reliminary investigation into these allegations. . .

    It may be in Fr. Jeyapaul’s interest to respond to the allegations that have been brought against him. My initial interest in communicating. with his proper ordinary is to inform him of these allegations as well as to enlist his assistance in communicating my decree to Fr. Jeyapaul. I would also ask his ordinary to see to it that Fr. Jeyapaul has no more communication with the alleged victim. Eventually, if the investigation leads me toconclude that the allegations have basis. further conversation might be called for in order to determine how to proceed.

    I would be very grateful for any assistance you can offer in these matters.

    I am sorry to have to inform you that the civil authorities are investigating Fr. Jeyapaul’s actions, specifically those relating to the sixteen-year-old girl that I spoke of in my last letter. Thus it appears that the allegations made, if they are established to be true, possibly involve a civil crime as well as a canonical one. As such, I have the following requests which I would appreciate your help in carrying out.

    As I have already mentioned, the civil authorities of Rosseau County are exploring the possibility of charging Fr. Jeyapau] with a crime in the civil courts. In the interest of justice I ask you to urge Fr. Jeyapaul to present himself to the authorities if they request it and to cooperate fully in whatever process ensues. If his actions have been criminal, he must be prepared to face the consequences, and to do whatever possible to make amends to the victim and her family.

    Finally, given all that has been outlined here, I would like to point out that there are grave reasons to doubt Fr. Jeyapaul’s fitness for ministry. As such, I request you, again as his ordinary, to take whatever steps are necessary to prevent him from hanning others.

    My canonical investigation into Fr. Jeyapaul’ s activities is on-going. The investigator has prepared a list of questions for Fr. Jeyapaul to respond to if he chooses, and I am enclosing that list with this letter. I suggest you discuss with Fr. Jeyapaul the advisability of his responding to these questions, and if it is detennined that he ought to respond I ask that you see that he does so fonnally, in writing, and in the presence of an ecclesiastical notary. I would then ask that his fonnal response be sent to me by regular post, and that it is received by my office no later than 1 December 2005. When the investigation is complete I will see that a copy of the report is sent to you, along with a summary of the disciplinary steps that I have taken.     Your Excellency: In accordance with Part II, Article 13 of the motu proprio Sacramentorum sanct/tatis tutela, I am wliting to inform you of a case involving the sexual abuse of a minor by a cleric of the Diocese of Ootacamund. This cleric was serving as an extern priest in the Diocese of Crookston at the time the alleged abuse occurred, and the victim is a sixteen-year-old girl who resides in the diocese. At this time the cleric has returned to his diocese of incardination. Nonetheless, the circumstances of the alleged abuse, along with the provisions found in the Essential Nonns for Diocesan Policies Dealing with Allegations ofSexual Abuse ofMinors by Priests and Deacons, necessitated that I order a preliminary investigation into the allegations. The investigation has now been concluded and, in my opinion, the results of this investigation suggest that it is probable that a canonical delict was conunitted. Thuf\I am transmitting to your esteemed Congregation the results of this investigation, and requesting that, due to the special circumstances of the case, the Congregation call the case to itself. Father Joseph Pavanivel Jeyapaul was ordained a priest for the Diocese of Ootacamund on 19 May 1982. In September of 2004 he came to the Diocese of Crookston to serve as an extern priest for a period of at least three years. Fr. Jeyapaul was received as an extern based on reports of good conduct received from his Diocesan Administrator, Very Rev. Msgr. A. Antony Samy. A background check was conducted at that time, and no items were uncovered that were a cause for action. Fr. Jeyapaul served as parochial vicar to the parishes of Warroad, BaUdette, Williams and Falun from October of 2004 to May of 2005, and then was appointed administrator of Blessed Sacrament Church in Greenbush, Minnesota, of SI. Joseph in Middle River, and of SI. Edward in Karlstad, Minnesota. In September of 2005 he returned to India to be at the bedside of his dying mother. He left with my permission, and with expectation that he would be returning to the diocese to complete his term. However, beginning in September of 2005 the Diocese of CroQkston began receiving reports of inappropriate behavior on the part of the Fr.     In the course of the preliminary investigation it became apparent that Fr. Jeyapaul was indeed counseling the alleged victim about her interest in religious life, and that he was using this circumstance as a means of getting access to the girl away from the supervision of her parents. For instance, according to the evidence collected during the preliminary investigation, on one occasion (22 August 2005) Fr. Jeyapaul visited with the parents of the alleged victim about her discernment process. Following the visit Fr. Jeyapaul asked that show him around the neighboring town, Thief River Falls, where she attended school. However, rather than going to Thief River Falls, Fr. Jeyapaul took 7 then sixteen-years-old, to his rectory in Greenbush, where, according to her report, he proceeded to kiss her repeatedly, pulling her on top of him and at one point touching her beneath her clothing. According to the testimony collected, there were other incidents of similar behavior between Fr. Jeyapaul and • • • always occurring at the rectory in Greenbush. As has been mentioned, before the investigation into his conduct was begun, Fr. Jeyapaul returned to India to visit his dying mother. Prior to his leaving he misappropriated a substantial amount of money belonging to the parish, and also attempted to gi ve a diocesan vehicle to a third party as payment for an outstanding debt. This matter has been brought to the attention of Fr. Jeyapaul and his 10caJ ordinary, as have the allegations of sexual misconduct. To date, Fr. Jeyapaul has chosen not to respond to questions presented to him by the investigator. With a civil process pending and a criminal investigation ongoing, I have requested that Fr. Jeyapaul return to the diocese so that he can be made accountable for his actions. I have had no indication from him that he intends to return. Following the conclusion of the preliminary investigation, I removed his faculties and asked him to refrain from exercising any public ministry in my tenitory. I also instructed Fr. Jeyapaul to avoid any further contact with the alleged victim. Since Fr. Jeyapaul is presumed to be residing in his home diocese, the Diocese of Crookston is not cun-ently providing him with any sort of financial support. . Because of the recent date of the alleged misconduct, it is impossible to say that Father Jeyapaul does not at present pose a risk to minors. Furthermore, because of the nature of sexual abuse, it is not possible to predict with any accuracy whether he would pose such a risk in the future. I have aJerted the United States Conference of Catholic Bishops to my concerns regarding Fr. Jeyapaul, to prevent him from attempting to engage in public ministry in another diocese in this country. At the same time, the Diocese· of Crookston will do whatever it can to negotiate with any victims that might be discovered, as well as to assist with their emotional and spiritual healing. Given the unusual circumstances of this Case, namely that the accused priest is an extern to my diocese who has since returned to his home country, I am asking that your esteemed Congregation call the matter to itself, and apply whatever penalty you feel appropriate. To this end I am sending you the complete report from the preliminary investigation. For my part, I cannot in good conscience allow this matter to be passed over because the cleric has left my ten·!tory. In my mind that would be a shameful act of betrayal towards the women and girls in India to whom Fr. Jeyapaul could at present pose a serious risk. I would add that I have been in communication with Fr. Jeyapaul’s Diocesan Administrator about ~his matter, but that he has notbeen successful in ending Fr. Jeyapaul’s attempts to communicate with the victim and her family. Your Excellency, I am extremely grateful to you and to all the members of your esteemed Congregation for the great assistance you have provided to the bishops of the United States, and for the leadership you have exercised in helping to resolve these issues which have so wounded the Church. If you need fulther information in this case, I will be pleased to provide it to the best of my abilities. I send you my own personal regards and the assurance of my prayers.

This cleric was serving as an extern priest in the Diocese of Crookston at the time the alleged abuse occurred, and the victim is a sixteen-year-old girl who resides in the diocese. At this time the cleric has returned to his diocese of incardination.
    This is not the first occasion on which r am reporting to you allegations against this priest. In December of 2005 r transmitted to your esteemed Congregation the results of a previous investigation, also involving a sixteen-year-old girl. You responded that you had advised the cleric’s ordinary”to see that his priestly life was monitored. However, given the most recent allegations, which are much more serious, I am afraid that a new investigation, and possibly a more severe penalty, is necessitated.

    In most cases, the circumstances of the alleged abuse, along with the provisions found in the Essential Norms for Diocesan Policies Dealing with Allegations ofSexual Abuse ofMinors by Priests and Deacons, would necessitate that I order a preliminary investigation into the allegations. However, given that the Diocese of Crookston is prohibited from investigating the matter because of an impending civil suit, and because the cleric is no longer under my jurisdiction, beginning such an investigation at this time would appear pointless. Thus I am transmitting to your esteemed Congregation the information that I have been able to assemble, and I am requesting that, due to the special circumstances of the case, your Congregation investigate the matter itself.

Now, in 2006, the Diocese of Crookston has received reports of similar behavior having taken place between Fr. Jeyapaul and a second girl, , also considering religious life. According to the reports made by the girl’s father to the local priests and then to the Diocese (enclosed), Fr. Jeyapaul had ‘rubbed up against her’ in the rectory at Middle River, in the confessional at Middle River, and then had fondled her breasts, exposed himself to her, and forced his penis into her mouth. Fr. Jeyapaul was made aware of these most recent allegations, and responded to them. His response, along with that of his ordinary, is enclosed. Because of the recent date of the alleged misconduct, it is impossible to say that Father Jeyapaul does not at present pose a risk to minors. Furthermore, because of the nature of sexual abuse, it is not possible to predict with any accuracy whether he would pose such a risk in the’ future. I have alerted the United States Conference of Catholic Bishops to my concerns regarding Fr. Jeyapaul, to prevent him from attempting to engage in public ministry in another diocese in this country.     In 2004, the Rev. Jeyapaul Joseph Palanivel was accepted by the U.S. Diocese of Crookston in Minnesota for parish work. The arrangement had been proposed for Jeyapaul, as the priest is usually known, by his home diocese of Ootacamund in the state of Tamil Nadu in southern India. Jeyapaul was in Crookston for less than a year, but in that brief time, he is accused of sexually abusing two female minors, is suspected of abusing at least one other girl, and is now the subject of a police investigation and a civil suit. Jeyapaul is also accused of taking money from the Crookston diocese.

    Crookston bishop Victor Balke wrote repeatedly to the Congregation for the Doctrine of the Faith, urging it to take the Jeyapaul case, and even appealed to the dicastery in person. Yet as of April 5, 2010, over five years after he allegedly committed the crimes, Jeyapaul is a senior official in the Diocese of Ootacamund, with the schools as one of his portfolios, and the CDF has ignored the case.

    This page provides documents that were obtained by counsel for the plaintiff in the civil suit, Jane Doe 121 v. the Diocese of Crookston. At a time when the role of the Vatican bureaucracy in abuse cases is coming under increased scrutiny, the Jeyapaul documents show the Vatican allowing a priest to remain in ministry, though the CDF has long possessed strong evidence that he is credibly accused. At a time when foreign priests are being used to patch a U.S. priest shortage, the Jeyapaul documents cast doubt on the formation of such priests, and on the system’s ability to monitor and discipline them effectively.

    Below we provide a timeline of the Jeyapaul case with links to dozens of documents. The paper trail of neglect by Cardinal Levada at the CDF is contained in five documents: Bishop Balke’s original 2005 request, the CDF’s inadequate response, and then Balke’s increasingly urgent letters, as the case worsened in his own diocese: see the letters he wrote in November 2006, December 2006, and March 2007.

    12/07/05 FIRST LETTER TO CDF – Bishop Balke wrote to Cardinal William Levada, the head of the Vatican’s Congregation for the Doctrine of the Faith. Balke wrote that Jeyapaul took a sixteen year old girl to his rectory in the Diocese of Crookston and “kissed her repeatedly, pulling her on top of him and at one point touching her beneath her clothing …. there were other incidents of similar behavior between Fr. Jeyapaul and [the sixteen year old girl].” The abuse happened between 2004 and 2005. Bishop Balke also stated that “because of the recent date of the alleged misconduct, it is impossible to say that Father Jeyapaul does not at present pose a risk to minors.” Balke also asked the CDF to take the matter and penalize Jeyapaul as it sees fit.     5 Months After Bishop Balke’s Letter to the CDF

    5/18/06 Archbishop Angelo Amato, secretary at the CDF, wrote back to Bishop Balke that the CDF had gotten the information on Jeyapaul. The CDF stated that it examined the situation and communicated the facts to Jeyapaul’s Bishop “with the request that Father Jeyapaul’s priestly life be monitored so that he does not constitute a risk to minors and does not create scandal.”

    10/2006 Diocese of Crookston received allegations that Jeyapaul had sexually molested a second girl, Jane Doe 121 (she is “Girl 2” in our redactions of the documents)

    11/15/06 SECOND LETTER TO CDF – Bishop Balke wrote to Cardinal Levada, the Vatican’s head of the CDF, that Jeyapaul had been accused of sexually molesting a second girl. In the letter Balke told Levada that the allegations were that “Fr. Jeyapaul had ‘rubbed up against her’ in the rectory at Middle River, in the confessional at Middle River, and then fondled her breasts, exposed himself to her, and forced his penis into her mouth.” Balke wrote that “it is impossible to say that Father Jeyapaul does not at present pose a risk to minors.” Balke wrote that due to this second allegation possibly a more severe penalty was necessitated.

    11/2006 MEETING WITH CDF – Bishop Balke met with the Congregation for the Doctrine of the Faith to present the file on Father Jeyapaul.

    12/21/06 THIRD LETTER TO CDF – Bishop Balke wrote to Cardinal Levada and stated that law enforcement was going to pursue extradition of Father Jeyapaul in light of the most recent allegations. Balke asked for information about Jeyapaul’s whereabouts and also for a speedy resolution.

    12/28/06 The Vatican’s apostolic nuncio wrote to Bishop Balke that Jeyapaul’s current residence was at St. Joseph’s church in Kalhatti, India. The nuncio’s enclosure shows that he had corresponded about the Jeyapaul case with the then-apostolic nuncio of India, Archbishop Pedro López Quintana, now the nuncio in Canada

    3/05/07 FOURTH LETTER TO CDF – Bishop Balke wrote to Cardinal Levada at the Vatican’s CDF and enclosed emails suggesting that Jeyapaul violated the sacramental seal of confession and that the information should be included in the CDF’s file on Jeyapaul.

    3/7/07 A criminal complaint is filed in Roseau County District Court alleging oral penetration of Girl 2 by Jeyapaul, who is also alleged to have threatened her and her family.
    8/02/07 Fr. Jeyapaul wrote to a parishioner in the Diocese of Crookston and the letter was passed along to the Diocese of Crookston. The letter stated that Jeyapaul is currently the secretary for the Diocesan Commission for Education in the Diocese of Ootacamund, India. He stated that they have 40 schools in the diocese. He also requested money so that he can have toilets built for the children at the schools. Finally, Jeyapaul wrote that a Jubilee Mass (25 years in priesthood) was celebrated for him.

    9/18/07 Balke wrote to the Vatican’s apostolic nuncio in Washington to verify that Jeyapaul’s current address is Bishop’s House in Ootacamund.

    9/21/07 Archbishop Sambi, the Vatican’s Apostolic Nuncio, wrote back to Bishop Balke that he didn’t have a current address for Jeyapaul, but Bishop Balke could write to Jeyapaul’s Bishop in India.

    2/7/08 Jane Doe 121 v. Diocese of Crookston complaint is filed

    But letters released Tuesday by a lawyer for the Holy See in the United States show that the priest, the Rev. Joseph Palanivel Jeyapaul, was told by his diocesan administrator in India of the accusations in 2005 and urged to cooperate with church and civil authorities. He continues to work in an administrative position in the Diocese of Ootacamund.

    The lawyer, Jeffrey Lena, said that the Vatican had recommended that the priest be defrocked but that canon law dictated that the decision rested with his superiors in India. They ordered him to undergo counseling and spend a year in prayer.

    The Vatican clarified and streamlined its procedures in 2001 to respond to sexual abuse accusations against priests. As Pope Benedict XVI has come under fire for his handling of sexually abusive priests in Germany and Wisconsin, the Vatican has sought to defend him by pointing out that he was an architect and a promoter of these procedures.

    But the Vatican’s policy of deferring to local bishops may also leave it open to criticism that it is not acting aggressively enough.

    Criminal charges were filed in Minnesota in December 2006 against Father Jeyapaul after a teenager accused him of forcing her to have oral sex in 2004, when she was 14. Mr. Lena said the Vatican provided the priest’s location in India to authorities seeking his extradition.

    But a spokesman for the Indian Ministry of External Affairs said Tuesday that the Indian government had not been contacted about extradition. “We have not been contacted as of yet,” a ministry spokesman said.

    Father Jeyapaul’s supervising bishop, Bishop Arulappan Amalraj, said by telephone Tuesday that he did not know of the charges. “No, no, no,” he said. “There was no mention of a criminal case.”

    But Bishop Amalraj’s immediate subordinate was directly informed in 2005 that charges were possible by Victor H. Balke, then the bishop of the Diocese of Crookston in Minnesota, where Father Jeyapaul had worked. Bishop Amalraj was appointed to his post in 2006.

    Father Jeyapaul said Tuesday that he was unaware of any criminal case against him until he was contacted by reporters on Monday and that he would be willing to return to the United States to prove his innocence. “I am ready to do it,” he said in a telephone interview. “I want to explain myself, that I am innocent.”

    He said of the criminal case, “I don’t know anything.”

    Bishop Balke, in a letter dated Nov. 8, 2005, wrote to the administrator of the Indian diocese at the time, Msgr. A. Anthony Swamy, saying that civil authorities in Minnesota were “exploring the possibility of charging Fr. Jeyapaul with a crime.”

    He also wrote: “I would like to point out that there are grave reasons to doubt Fr. Jeyapaul’s fitness for ministry. As such, I request you, as his ordinary, to take whatever steps are necessary to prevent him from harming others.”

    Monsignor Swamy wrote back saying he had urged Father Jeyapaul to cooperate fully with church and civil authorities and that he “is sternly warned of any further mischief.”

    Bishop Amalraj conducted a canonical trial in 2006, which allowed Father Jeyapaul to continue working after a year spent in prayer, though without access to minors. He said Father Jeyapaul had worked in the diocese for 28 years without any problems or accusations

    Father Jeyapaul said he left Minnesota on Aug. 28, 2005, to visit his sick mother in India, and received an e-mail message on Sept. 15 from Bishop Balke, telling him that a 16-year-old girl had accused him of molesting her.

    “I told them that I will come back and prove that I am innocent,” he said. “But the bishop withdrew the invitation. He said not to come back.”

    But in a letter dated Dec. 7, 2005, Bishop Balke told the Vatican that he had requested that Father Jeyapaul return to Minnesota to “be made accountable for his actions,” but that he had had “no indication from him that he intends to return.”

    Bishop Balke’s letter was addressed to Cardinal William J. Levada, the prefect of the Congregation for the Doctrine of the Faith, the Vatican office handling abuse cases against priests.

    The Vatican responded in May 2006, informing Bishop Balke that it had relayed his concerns to the diocese in India “with the request that Father Jeyapaul’s priestly life be monitored so that he does not constitute a risk to minors and does not create a scandal among the faithful.”

    Bishop Balke then sent two more letters to Cardinal Levada informing him that a second teenage girl had come forward with serious allegations, that criminal charges had been filed and that the county attorney in Minnesota wanted to extradite Father Jeyapaul. He urged quick action.

    Bishop Balke also wrote to the Vatican’s top diplomat to the United States, Archbishop Pietro Sambi, who provided the address of Father Jeyapaul in India to give to the county attorney.

    The woman in the criminal case, now 20, has sued the Diocese of Crookston. Her lawyers released some of the documents in a news conference on Monday.
